If I give my gf an engagement ring and then we don't marry, do I get the ring back?

If you give it to her and she says no on the spot, then yeah.

If you give it to her, she says yes, time goes by, something doesn't work, and you break up...well, I guess if you can wrest it off her finger.

i'm pretty sure legally it's considered a gift. so i don't think she doesn't have to give it back.

I guess it also depends on how the engagement was broken. If you walked in on her sucking off two of your friends, then she should probably give it back.

A case like this went all the way up to the Kansas Supreme Court by an obviously bitter guy and they ruled in his favor. The ring is still his until the "contract" is complete.

I think it depends on the circumstances of the break up. If you cheat on her or do something really bad, I think she should get to keep it and sell it. If you guys have an amicable break up or if SHE does the cheating or something awful, then she should give it back.

Nope. It's 100% a contractual obligation to marry. No matter what the circumstances of the break-up, she has to give it back. The ring itself is a contract saying 'I'll marry you.' If that transaction doesn't go through, you are to get the ring back.

If they don't give the ring back, you then have a right to sue to get it back.

I'm pretty sure this goes for all states.
