I never understod this trying people twice thingy. I know it's a mundane, elemenary legal matter for all you experts out there, but just looking at it from the outside, it seems just a little teeny weeny little bit like double jeopardy.

Cant say I blame her. She's getting raped by the judge and all the mysterious "leaks" that keep happening.

If someone shot you, would you not want to sue them (at least to recover your medical expenses and income lost), whether or not they were convicted in a criminal trial?

"Jane Doe" claimed Bryant raped her when she was bent over a chair in his hotel room in a Vail-area resort last year -- a claim that matches the criminal charge against him.
If she was bent over a chair, wouldnt she have to assume that position?

actually.. thanks to mistakes by investigators and the prosecutor.. The criminal charges against kobe will probably go away, guilty or not.

And noone in the world can say that didnt expect a civil case to also be filed.. that would just be damn naive.

as far as why you *have* to have seperate trials for criminal and civil cases.. I dont know.. i guess one of the lawyers in here can explain.. but I would assume that generally the outcome is the same in both trials.. Well, except with OJ

If I raped a woman, would she file a civil suit against me? Is this a normal occurence, or does it only become normal when the accused is rich and famous?

I don't know why anyone would be surprised that there would be civil suit.

I already explained why it makes sense for a victim to file a civil suit.

As for results being the same - hardly. The burden of proof is far lower in a civil trial. In a civil trial, the plaintiff need only meet the preponderance of the evidence standard (better than 50/50) whereas in a criminal trial, the state must prove guilt beyond a reasonable doubt (well above 90-95%).
