HW's POWER is what made that oppressive fear possible. So, it's hard to blame them since they were in fact VICTIMS of a powerful man.
For an example, we only have to go back to what happened last year. After the Access Hollywood tape leaked, a lot of woman who had been sexually assaulted through the years, but were too afraid to come forward based on what he could do to them professionally or personally thought they finally had the cover to come forward and tell their story. And nothing came of it, and we elected him President anyway.

It's simple: it's finally safe to say something. Prior to this, there was literally no upside. Any of those actress would be out of job if they spoke up.

Yeah, they chose their career over speaking up against one of the most powerful men in Hollywood, not being believed, humiliated and drummed out of the business. I get why they did what they did, completely.

Yes, there should be 0% of blame towards any of the actresses for not talking about this sooner.

As I said before the actresses shouldn't be blamed for coming out now, but why not come out against other dirty execs to actually stop this stuff (if there's more dirt in Hollywood besides Weinstein)? Not people they heard about but people who actually accosted them.

Harvey Weinstein's Contract Allowed for Sexual Harassment

Harvey Weinstein may have been fired illegally by The Weinstein Company, a company that wrote a contract that said Weinstein could get sued over and over for sexual harassment and as long as he shelled out money, that was good enough for the Company.

TMZ is privy to Weinstein's 2015 employment contract, which says if he gets sued for sexual harassment or any other "misconduct" that results in a settlement or judgment against TWC, all Weinstein has to do is pay what the company's out, along with a fine, and he's in the clear.

According to the contract, if Weinstein "treated someone improperly in violation of the company's Code of Conduct," he must reimburse TWC for settlements or judgments. Additionally, "You [Weinstein] will pay the company liquidated damages of $250,000 for the first such instance, $500,000 for the second such instance, $750,000 for the third such instance, and $1,000,000 for each additional instance."

The contract says as long as Weinstein pays, it constitutes a "cure" for the misconduct and no further action can be taken. Translation -- Weinstein could be sued over and over and as long as he wrote a check, he keeps his job.

The contract has specific language as to when the Board of Directors can fire Weinstein -- if he's indicted or convicted of a crime, but that doesn't apply here.

There's another provision ... he can be fired for "the perpetuation by you [Weinstein] of a material fraud against the company." The question ... where's the fraud? Lance Maerov, the board member who negotiated Weinstein's 2015 contract, said in an interview -- and we've confirmed -- the Board knew Weinstein had settled prior lawsuits brought by various women, but they "assumed" it was to cover up consensual affairs. The Board's assumption does not constitute fraud on Weinstein's part.

And here's the kicker. Even if Weinstein had committed fraud by not fully informing the Board of Directors, the contract says before he can be fired he has a right to mediation and if that doesn't work, he's entitled to arbitration. He got neither. He was summarily fired, and sources connected with Weinstein tell TMZ he was never given a specific reason.

A source connected with TWC tells TMZ, the company had a right to fire Weinstein if he didn't notify the Board of Directors of settlements. We're told there have been no settlements since the contract was signed, so it would seem this clause does not apply.

I'm surprised there's no clause that states if he causes embarrassment to the firm. There's no way he's coming back to his job after this, or the public outcry will be enormous against them.

TWC was failing before this disaster. They're pretty much done as this point. Can't imagine anyone wanting to do business with them going forward, with or without Harvey. Every release will be boycotted. They'll change the name and try to distance themselves but too little too late.

I remember they (TWC) constantly were delaying movies, I assume due to financial issues.

I wonder if I can get replacements for the few TWC movies I have where the logo won't be attached to the movie.

Yep. They're fucked.

The Weinstein Co. Nears The Brink As Agencies Cut Off Talent Supply

"Numerous sources both inside and outside the company paint a dire picture of a business in extreme limbo, as Bob Weinstein and Glasser struggled doggedly to keep things together and prevent a flood of pink slips. While litigation is certain to dictate the specifics of the company’s future, the immediate tasks of operating a company–developing scripts, booking theaters, creating marketing materials–are increasingly fraught."

Yes, but we live in a capitalistic society.

Imagine that you go from making lattes at Starbucks to a six-figure dream job that could turn into seven or eight figures in a couple of years. You're going to be willing to look the other way for a lot of shit that won't actually land you in prison.

And if you do the right thing and speak up, the guy won't be punished and you'll be dragged through the mud and have your career destroyed. The woman who says Harvey Weinstein tried to rape you is going to be unhirable in show business. You'll be labeled a bitch and a liar and a flake. You'll be lucky to get a commercial for a used car dealer in Omaha.

So what can be done about this? That's the discussion that needs to happen.

Tarantino doesn't have too much to say yet, but there's this:

There's no way QT didn't know what was going on with HW all these years. Those two were like best buds.

It's always amused me when I see "Hollywood" movies using corporations as a villain or a symbol of Evil when Hollywood is the biggest "Corporate Town" in the world. This is just more evidence of that...

I have a hard enough time believing Matt Damon didn't know about, let alone Tarantino.

I don't believe for a second that none of them knew. They might not have first hand experience, but there is no way that they have not heard something about him (and others). None chose to speak up because it would be career suicide (and I don't blame them), but they are all complicit in keeping the machine running.

You should always separate storytelling from reality. Crime, guns, sex, violence ... it all has its place in fiction. Just because Hollywood makes Transformers, doesn't mean they're programming you to adore guns and weaponry.

All of these stories have their place in fiction. And it's not about sending messages or brainwashing viewers.

That said, I'm cynical about people's intelligence and think most of the world IS too dumb to understand the difference ... and why it's not okay to watch a Tarantino movie where people gets their limbs chopped off, and go out and chop off people's limbs (like they would if they could).

Sexual harassment and mistreatment of women occurs in every industry and in every country in the world.

As for those wondering why the victims didn't come out earlier, come back to us after you've been sexually harassed or raped and let us know how easy it was to report it.
