I watched the Married with Children "It's a Horrible Life" 2-part episode on YouTube. I enjoyed them. Thanks for the recommendation.

The Slate article says that it's the music rights that are the problem. So as long as they don't use the music, couldn't any yahoo release a "sequel"?

You missed this part:
"Republic regained control of the lucrative property in 1993 by flexing a new Supreme Court ruling that determined that the holder of a copyright to a story from which a movie was made had certain property rights over the movie itself."

What I gather from this is that the footage itself (minus the music) is still public domain, but the story isn't... so you could legally incorporate the footage into another project out of context, so long as the story is 'changed' (which is the tricky part). So I suppose the claim is based on the fact this 'sequel' retains some of the original story elements (references to characters) that are protected. But I'm not a lawyer, so this is just my layman's interpretation.

I've already been working on a movie of the same title, but mine is a biopic about Harry Nilsson.

I think you are on to something ... a prequel titled:

It's a 1derful Life

Personally I prefer the re-imagined version with Paul Bettany and Dennis Quaid.

I think Microsoft already has this lined up as a holiday special, showing prospective game console buyers how horrible their lives will be if they pick the PS4.
