It took re-reading your post again to make me remember that there was in fact a Christmas Story 2, so I think your theory is correct.
Then, last year there was the DTV "A Christmas Story 2". I personally don't like It's a Wonderful Life, so this news doesn't exactly bother me although I think it's kind of odd. Isn't the longest gap between sequels right now The Odd Couple & The Odd Couple II? |

The sequel, titled “It’s A Wonderful Life: The Rest of the Story,” is being produced by Allen J. Schwalb of Star Partners and Bob Farnsworth of Hummingbird. The duo are aiming to get the movie into theaters for the 2015 holiday season. Farnsworth and Martha Bolton have written the screenplay. Hummingbird Productions designs audio and produces music for commercials. There was a sequel, of sorts, to It's a Wonderful Life: a 1990 made-for-TV movie called Clarence, the further misadventures of George Bailey's bungling guardian angel. I saw it once. Clarence has been messing up; he had lost his wings and is further punished by aging in reverse. He helps some people and some other stuff happens. It was so exciting, I couldn't stay awake.

Update: Thankfully, it looks like this sequel won’t be happening. According to a report from the AP, a Paramount spokesperson said no film related to It’s a Wonderful Life can move forward with a license from the studio. They added, “To date, these individuals have not obtained any of the necessary rights, and we would take all appropriate steps to protect those rights.” |

The Slate article says that it's the music rights that are the problem. So as long as they don't use the music, couldn't any yahoo release a "sequel"?

"Republic regained control of the lucrative property in 1993 by flexing a new Supreme Court ruling that determined that the holder of a copyright to a story from which a movie was made had certain property rights over the movie itself." What I gather from this is that the footage itself (minus the music) is still public domain, but the story isn't... so you could legally incorporate the footage into another project out of context, so long as the story is 'changed' (which is the tricky part). So I suppose the claim is based on the fact this 'sequel' retains some of the original story elements (references to characters) that are protected. But I'm not a lawyer, so this is just my layman's interpretation. |
