Magazines do that all the time. I can't even come close to count how many times video game magazines have done the same thing. They give something the title of "the best of xxxxx" and then have a full exclusive look at the sequel. It's just a marketing ploy.

A lot of those I wouldn't consider "Action" movies. I guess my interpretation of different genres is a little more narrow than EW's

Pretty, good list, just a few comments on the top few in my opinion:
Die Hard - I don't care its a cliche now, but this movie pretty much rocks all the way through. Great lead, great villian, and great supporting cast. More importantly, I think its the attention to detail that really makes the movie go and feel real.
Aliens - Man, this movie just rocks. The first hour of the movie is pure tension (and thats why some people prefer the theaterical cut to the director's cut). And then the whole thing explodes. Once that happens, its pretty much constant.
Terminator 2 - Another JC classic. Terminator might be a more original film, but the set pieces in play here are just crazy. Robert Patrick may not have been able to do much of anything else, but he could play the T-1000 perfectly. It kinda drags for a bit in the middle and becomes a bit preachy, but who cares? I'm not sure why this isn't higher than #10.
Raiders of the Lost Ark I'm pretty convinced this movie is the ultimate comic book movie. The convoy scene remains a classic and as exciting as the first time I saw it.
Road Warrior High octane awesomeness.
As for the list, here are some questionable ones:
Seven Samurai - its the inspiration for a lot of other movies, but its pretty slow.
Saving Private Ryan - as for action, well the first and last scenes are good, but I never really liked this movie for some reason. I prefer Band of Brothers anyday.
Speed - This movie really hasn't aged that well, IMHO.
Predator - Man that movie needs to be higher on the list. Another McTiernan Classic - with Arnold!!!
I admit that I'm a sucker for Arnold's Earlier Epics (Commando, Red Heat, Raw Deal) They just don't make'em like they used to. I think Total Recall should be higher than it is.
I have no idea why movies like Spiderman 2, Mission Imp. 3 are as high as they are. I don't think Spiderman belongs at all on the list and MI 3 should be like #50.
In terms of action, I think Lethal Weapon 2 is better than #1 ,but what do I know?
