The $50 gift card was for the person who bought and owned that steelbook, and your right to use it was forfeit the moment you decided to return the steelbook. Just because you got away with it doesn't mean you didn't do anything unethical. |

Yes, I opened it - but it doesnt constitute opening the steelbook is non refundable. Take note, on the mechanics of the rules - its about the "receipt" not the steelbook 3. Dude, for info - after presenting my evidence to American Express, with no doubt my right as a consumer and my understanding about the Law are all done in legal matters. Now that youre creating a new set of rules (based from your ridiculous understanding) I suggest, go back to consumer 101. Unless, youre a Best Buy associate in profession and cannot withstand consumers like me?

For Best Buy, they issued you the steelbook in the expectation of either you going through with the pre-order and purchasing the set when it came out, or returning the intact steelbook for a refund of your deposit. If Best Buy didn't fully refund you, then there must've been a good reason for doing so. For SideShow Collectibles, they included the $50 gift card for those who pre-ordered and bought the full set. However, they had no way to verify before you used the card that you were going to go through with the preorder, so they were trusting that you and the majority of people wouldn't abuse it. For AMEX, I'm still not sure how they're involved, but if you requested a chargeback of the balance that Best Buy didn't refund, then AMEX was likely depending on your being a honest customer in terms of your dealings with Best Buy. They likely favor trusting the customer over the merchant, and they pass the chargebacks onto the merchant, who has to pay for them. Did you tell Best Buy or AMEX that you had used the $50 gift card inside the steelbook before returning it? |

As a merchant, 95% of the time you get an AMEX chargeback, you're fucked. They almost always take the consumer's side, right or wrong.

If you read my previous post (I marked the one in "Red" which is Damaged) - thats why it was "Opened" And the reason why Amex got involved, Bestbuy gave me a "Gift Card" instead of the monetary credit card tender I paid.
