I saw the simpsons Treehouse of Horror at CC & they wouldnt let me buy it!

I was at Circuit City I and I luckily stumbled upon The simpsons Treehouse of horror for only $10. I snatched the only copy I saw and rushed to the register. But after scanning it he wouldnt let me buy it!! He said it is not supposed to come out till Tuesday and he cant sell it He did let me have the $.01 DVD that has 12 music videos on it though.

Having worked at CC for 3 years, I can tell you that even if he wanted to sell you the disc, he couldn't. The system prevents the sale of new release prior to street date. It just beeps at you and tells you its not for sale yet.

Although from a customer perspective they shouldn't even have them on the shelf. It's like waving food in front of a dog and then putting it back in the fridge.

shoulda kicked him in the nuts, grabbed the DVD, threw down $10.59 on the counter & sprinted for the door...

sure they couldn't sell it but if it's not out yet then it shouldn't even be on the shelves.

I'd argue that if it is on the shelves with a price tag, they are under an obligation to sell it--it's a contract. By placing an item on the shelf with a price tag, a store creates a contract with consumers that the consumers can bring the item to the price register, pay the amount on the price tag, and purchase the item. By bringing the DVD to the register, homerun31 accepted the terms of the contract and Circuit City was under an obligation to follow through. Yes--doing so would have broken the street date, but if that was their concern, the discs should have never been on the shelves.

Having a lot of knowledge on contracts, this is not a valid contract, but simply an offer. The contract for retail business is official when money and items exchange hands, since the dvd was not given to the customer and CC didn't take his money, it is not a legal contract under law.

Haven't gone to law school Jedediah, have you? Contracts is basic 1st-year stuff, and what you write above is completely off-base. Watching a few lawyer shows on tv won't hold water in the real world, sorry to say...

They didn't refuse to serve him. He was able to buy one of the DVDs he brought up, and he can go back on Tuesday and get the service he wants to get the prestreet DVD on the day it comes out. They cannot sell a pre street DVD. To point out Wal Mart has broken prestreet is not validation for Circuit City or any other store to risk their jobs and to risk being fined because you want a title two days early. If you can't wait until Tuesday, then you have problems. They made a mistake by putting it out early, yes, but why should they compound the one mistake by selling it early as well? Once they discovered the error, the corrected it. End of story.

is Circuit City better then best buy in the states? as far as price goes?

I've never been to one. we just got best buy here in canada. as they own future shop now but the funny thing is future shop has lower prices then best buy.

sorta seems strange that CC would have a copy out if they can't sell it. I've never seen that here in canada. Sure would make me want to walk out and take my business else where.
