Return DVD to Amazon if only disc top scratched?

I just got my Batman Beyond pre-order from Amazon and the top of the disc was scratched [many tiny little scratches on the lower half of the top of the disc], not the side that the player reads. Since these scratches do not effect the proper play of the disc will Amazon accept this return/exchange as a defective item? Any thoughts? Thanks!

go ahead and call in or email them for a return. If you ordered something new, don't you expect it to be new? I would definitely let them know about the condition of the DVD. Besides, Amazon is cool about that, they should send you one immediately and then you can return your defective disc with the return slip. I had no problems with them before with MI:2.
