Actually I bet United could take action against the singer. I'm sure "United" is a registered trade mark and can not be used without permission. Now the public outcry if they did take action would probably be teh bad. But I bet they could.

Not in this case they couldn't. It's a commentary, sung, but still a commentary. You could also argue that it's parody and/or satire.

I know people at Taylor - I could have them make this guy a guitar at cost (which would make the 3500 closer to 1500). Although I'm pretty sure they heard about this and already sent him one.

LOL...maybe...but he is making money off of it. Either directly or by getting more gigs, more exposure, appearances, etc.

Plus I don't think you can call something a "commentary" and use a registered trademark.

For example, I've seen cases where an individual will put a sign in their yard saying something like; "ABC Plumbing screwed up my house". And ABC Plumbing was able to go to court and have the people remove the sign.

I've also seen cases where someone starts a web site; "AcmeAutomotiveSucks.com" and Acme Automotive has the site taken down.

I don't see how that works. If I buy a Brand X computer and it breaks 3 times in a month, I certainly have the right to write a bad review of it on Amazon, or post it in a blog for everyone to see. As long as I stay factual, I see no reason why I can't do that. Registered trademark doesn't mean I can't speak or write the words.

I think they got the guy with the sign in his yard with some law that you can't have any sign in the yard, even one that says "ABC Plumbing is great. They do excellent work for cheap".

First of all, a trademark is a logo or symbol, not just the name of the company. At no point in the video does he use United's logo.

Airline gives to charity in guitar gaffe

HALIFAX–Dave Carroll is getting ready to sing a happy tune.

United Airlines, the company whose customer service prompted the musician to write a song that's garnered worldwide attention, has agreed to make a donation to charity to make up for its mistakes.

"United will donate $3,000 to the Thelonious Monk Institute of Jazz for music education for kids," a spokeswoman said yesterday.

Carroll had spent several months dealing trying to get United Airlines to reimburse the $1,200 he paid to repair a $3,500 Taylor acoustic guitar damaged on a flight to Nebraska in March 2008.

He had requested that United direct any compensation to charity.

"I think it's pretty great and a show of good faith to help other people," Carroll said before performing with his band, Sons of Maxwell, in Arichat, N.S.

The airline's change of heart came after "United Breaks Guitars" appeared on YouTube this week, gathering 1.5 million hits by Friday night and coverage on CNN.

Taylor is giving Carroll "a guitar or two for my troubles," he said.

THE SECURITY TASK force guy explained everything to me.
Baggage handlers can ignore a ticking suitcase. The security task force guy, he called baggage handlers Throwers. Modern bombs don't tick. But a suitcase that vibrates, the baggage handlers, the Throwers, have to call the police.
How I came to live with Tyler is because most airlines have this policy about vibrating baggage.
My flight back from Dulles, I had everything in that one bag. When you travel a lot, you learn to pack the same for every trip. Six white shirts. Two black trousers. The bare minimum you need to survive.
Traveling alarm clock.
Cordless electric razor.
Toothbrush.
Six pair underwear.
Six pair black socks.
[One Taylor guitar.]
It turns out, my suitcase was vibrating on departure from Dulles, according to the security task force guy, so the police took it off the flight. Everything was in that bag. My contact lens stuff. One red tie with blue stripes. One blue tie with red stripes. These are regimental stripes, not club tie stripes. And one solid red tie.
A list of all these things used to hang on the inside of my bedroom door at home.

I've had my website for almost 10 years, I've been interviewed on NPR about it, BBI corp knows about it, warns employees not to post on it, and I have never been approached. (See Sig)

It's a pretty genius move on his part. Got a free guitar or two, plus, and this is worth a lot more, free publicity.

Bottom line, united gambled and lost this time, but overall, i'm sure all the legit claims they've denied in the past and will continue to deny would still make it worthwhile for them...

Honestly though, the higher-end guitar cases used by Taylor (which I'm assuming this guy's guitar was in), can take quite a bit of punishment without damaging the guitar inside. You have to pretty much destroy the case (which is tough to do even if you're trying), in order to be able to hurt the guitar inside at all.

Yeah, that is what I thought, too. And don't the handlers work for the airport, not the airlines?
