Looks like i got scammed on ebay for dvds! Part II

Hey everyone...thread got deleted. Apparently Geoff doesn't want addresses/phone numbers or pictures posted. Fair enough. Just wanted to repost what i could find on Google Cache, and let everyone know whats been going on. I have had several other people email me this week. This guy got a lot of people. Help where you can. Feel free to email me through the site.

Looks like it finally got me. On 08.06.06 i won 13 auctions for various criterion dvds. The auction requested checks or money orders, which i thought nothing of since i have bought with people that way several times before. A few days later i noticed the seller (lasvegasdolphins) was no longer a registered ebay member. I sent an email asking why that had happened, and he wrote...

"I am working to resolve this ebay matter. A new user or two have sent in claims of non receipt of product that has been promptly sent. I am sorry for the inconvenience. If you have sent payment be assured that your item(s) will be sent. KS PS the 2 users that did this have ratings of zero and two. I am so mad!"

I didn't think to much about it since he has a perfect feedback score of 188, and after looking through it all seems to be from legit members getting their product, not just quick new members with 1-10 feedback.

My check cleared on 08.16.06 and i got a email back from him the same day saying "All items are being shipped as payments arrive. If you do not receive your package by the end of the week let me know and I will get a tracking number for you. ks"

this is the last i heard from him. his auctions/emails had a phone number on them that is dead (of course i didn't call until well after the check had cleared.) He put a diffrent # on the back of his checks, i called that number and no one seemed to know who he was. I have sent e-mails every other day all week last week looking for a tracking # or at least a actual ship date, and they have given me nothing. I filled out the item not recieved, thinking that mabe he would respond to that...still nothing. you have to wait ten days to even try to get your money back, and even then I can't since all my items were under 25 bucks, and ebay charges a 25 dollar service fee for such a problem... so if a auction is 26 dollars, you are eligible for 1 dollar back after their fee.

Nazz pointed us to the USPS fraud site at http://www.framed.usps.com/postalinspectors/fraud/MailFraudComplaint.htm I still have not recieved anything back from this after filing on 08/29

If you were scammed by Kenneth Southwell i would suggest filling out these forms, and posting withing the thread.

I would like to keep this thread going and try and get some justice on this. Not that I have nothing else in life. I just don’t like people like this getting away with ripping off honest folks. I’m out less then $50 and ebay will refund me $15 of it. I learned one thing for sure and that is no matter how good a persons feedback score is or how long they’ve had an account I’m only using Paypal. If I forget to look at the payment method and have to cancel the purchase I’ll do it. If I lose my 100% positive feed back at least I feel I have a good reason.

How many people has this guy has scammed?
Has anyone contacted the Henderson, Nevada police?
Has anyone sent this guy a registered letter?
Did anyone get the phone number of the realtor listing the house for sale? If someone has the realtors phone number there may be a way to call the realtor and get a phone number (if you’re a smooth or tricky talker anyway).
A lot of realtors list houses for sale online so has anyone been able to find that information?
How about Henderson, Nevada small claims count?
If I was this guy I’d be moving too, because everyone who got scammed has his address. With all the information available on the Internet someone’s going to find him.
Does anyone work for a retail company where they can search a database for a phone number (don’t get caught searching)? For example if someone worked for Sear or Best Buy he might have a credit card with them.
I have a few things I’m still working on to try and get a phone number, but I don’t want to divulge them here in case that Southwell punk is aware of this site.
What was that web site that has so much personal information on everybody, like where you work, estimated age and such? It was not a normal name.

I also apparently got scammed by this guy. $33.50 isn't a great deal but it's the principle of the thing. I've experienced basically the same scenario as you right down to the same info on my cleared check. The only difference is that I had purchased a couple of dvds from him about a month prior to this. I received them with no problems. Strange. Anyway I'm gonna go ahead and try to get something from eBay. Good luck!!

Just to let you know I in fact did receive my criterion dvd from this guy. I did not leave feedback, because I noticed he did not leave any what-so-ever for his buyers even though they left it for him. I still had the item under 'Items Won' and then one day I went to log onto my ebay account, it was suddenly gone. I can't retrieve at all. I try and pull up the last 10 transactions and stuff that I won prior to this dvd come up and then stuff that I've won since then also comes up. I've yet to figure out why ebay purged that particular transaction from 'my ebay' page. I did have the transaction # posted. Also worth mentioning, the day I noticed that the transaction was pulled I also could not locate this thread anymore through google or simply logging onto this site. Something is not right at all with this picture. What are your thoughts?

It sounds like eBay got rid of every trace of this guy, which would explain your winning auction disappearing.

The bitch of it is, I'd won some DVD's from him before, and they came on time and worked great.

The whole thing is maddening.

More on Southwell- after google searching him, I found this article, dated July 28 06;

The former firefighter and paramedic who admitted three years ago to setting fire to a grass seed warehouse in Fairfield has been ordered a second time to serve five years in prison and pay more than $4.5 million in restitution.

Kenneth Southwell, 55, had been convicted in 2004 in U.S. District Court of arson for burning the Heart Seed Co.'s warehouse in Fairfield. However, the 9th U.S. Circuit Court of Appeals overturned that conviction based on improper jury instructions, Deputy Spokane County Prosecutor Larry Steinmetz said.

The case was sent back to state court, and a new trial date was set for next month. But Southwell and his attorney, Matt Harget, agreed to a plea bargain Wednesday to essentially the same penalty he received in federal court.

"We attempted a global resolution and this is what we came to," Steinmetz said. "The court also ordered a mental health evaluation and treatment."

Superior Court Judge Jerome Leveque also ordered Southwell to pay $4.58 million in restitution, which Steinmetz said was the largest restitution he had ever asked for as a prosecutor.

Since Southwell has served 1,051 days in jail, he faces only another two years of that five-year sentence, Steinmetz said.

Harget, Southwell's attorney, could not be reached Thursday for comment.

In addition to the Heart Seed fire on Labor Day 2003, Southwell admitted setting five other previous fires in Fairfield.

In his taped confession to agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives, Southwell said he set the warehouse on fire because he was angry at his ex-wife. She had married a man who worked at the Heart Seed Co., and the couple had a child together.

The same man had been married to Southwell's sister.

In his closing arguments in the 2004 federal trial, U.S. Attorney Tom Rice argued that Southwell started the massive blaze because he "wanted to be the town hero."

After the federal conviction was reversed on appeal, a new trial date was set for next month in state court, Steinmetz said.

"We resolved both the federal and state charges in state court," Steinmetz said.
