Actually, I think the Kid Rock song fits under "mash-up", and since he probably had to get permission to use both songs, it wouldn't really qualify as "ripping off". From what I read, Lynyrd Skynyrd's keyboardist even played piano on the Kid Rock song.

Also, not a rip off when the artist openly acknowledges shared songwriting credit - which he did. Plus, Kid Rock even toured with Skynyrd when promoting this album, so I'm quite sure everything was cool between them.

There's been many times where I'll hear parts of a song meddling around in another; recently, the Duran Duran song "Falling Down" and Phil Collins' "Another Day in Paradise." I also thought Gwen Stefani's "This Love is Serious" took the strings and synth lines from "The Color of Success" by Morris Day.

Or Boston's "More Than A Feeling" (which the band acknowledged at Reading '92).

"Territorial Pissings" is a rip off of Jello Biafra's Lard project ("The Power Of Lard")

"Come As You Are" is a rip off of "Life Goes On" by The Damned or a Killing Joke song (they even ended up paying royalties to Killing Joke, but I think the Damned song may have preceded it).

Interesting timing of this thread as Colin Hay and Ron Strykert (Men at Work) are in the news in Australia today and are being sued by a company that claims they own the right to a very old chidren's song called "Kookaburra Sits In The Old gum Tree", claiming the melody of a line in "Down Under" was pinched from their kookaburra song.

And interestingly too. Strykert was arrested in Feb in LA for making death threats against Hay over the phone in late 2008. They are sure living in interesting times. :-)

Almost exactly? Not really. The choruses are completely different and there's a slight similarity in the verses but the melody and chords are different.

My favorite is The Eagles' "The Long Run" totally ripped off an old Memphis song called "Tryin' to Live My Life Without You" that was famously covered by Bob Seger on Nine Tonight.

Nothing better than releasing the exact same song, 20 years later, only difference is you say "Yeah" every once in a while. And the "new" recording sells 10x better than the original.

Fair enough. I think there's a real difference between openly "sampling" a song, and 'stealing' bits and claiming it as new and original. There are lots of examples of both. It might be huge, but there is a finite number of ways musical notes can be arranged.

The bass line in Marron 5's "Won't Go Home Without You" seems identical to the famous one Sting plays in The Police's "Every Breath You Take".

John Mayer's "Waiting On The World To Change" sounds an awful lot like Curtis Mayfield's classic "People Get Ready".

Re: Men at Work. Seems an Australian company would be wise not to sue over "Down Under." I'd think that's an easy way to end up forever "lost" in the Outback. And in multiple pieces.

I also think it's funny that (according to an AP story) the company says it bought the "Kookaburra" rights after the song writer's death in 1988. But "Down Under" was released in 1983. So not only did they not even (allegedly) own the rights until 5 years after the offending song was released, but they waited 21 years to file the lawsuit? Isn't there some sort of statute of limitations?
