Octogenarian Sues Apple For Collision Related Injury

A Queens woman is suing Apple for $1,000,000 after smashing her face on a glass door at a Long Island Apple Store.

Evelyn Paswall, 83, claims that the glass doors at the front of Apple Stores pose a risk to the elderly.

Paswall’s attorney Derek T. Smith told the Post that,“Apple wants to be cool and modern and have the type of architecture that would appeal to the tech crowd, but on the other hand, they have to appreciate the danger that this high-tech modern architecture poses to some people.”

Paswall claims that she didn’t realize that she was walking into a wall of glass as she approached the store, and says that she broke her nose as a result of the collision.

Her suit claims that “The defendant was negligent . . . in allowing a clear, see-through glass wall and/or door to exist without proper warning.”

As of Saturday warning strips had been posted on the glass at Apples Manhasset store.

Next she would probably break her finger using an iPad by trying to poke through it.. Anyhow is an 83 years old nose worth $1m?

I don't think she deserves $1mil, but the fronts of the Apple Stores can be pretty confusing with all the glass. We had glass doors and ceiling-to-floor glass windows at my old work, and we ended up having to put stickers on the windows because people were constantly walking into them.

I tried to eat my Apple because I thought it was fruit. They need to put warning stickers on all Apple products so that people don't confuse it with delicious fruit. I'm suing! $$$$$$

In the first video, the rug is turned the way you would expect it if the door was where the guy ran into the glass. Poor design.

In the second video, the rugs clearly mark the route to take. Poor idiot.

If the Apple stores have a history of people smacking into their windows, then it's probably poor design.

Although, idiocy can't be ruled out in this case.

Your eyesight and reflexes aren't what they used to be.

The thing is most commercial insurance policies (and homeowners policy as well) have "Medical Payments" up to a certain amount. This is separate from liability in that no fault needs to be assigned. You get hurt on the property, you are covered.

For example, a friend of my wife's was with her toddler at the grocery store. Leaving the store, to the parking lot, the toddle managed to wiggle out of the cart and fell and broke his arm. She took him to the ER thinking it was her/the kids fault. But she called the store who confirmed the injury took place on property (with their security camera's) and paid all of the medical bills (but nothing more).

This coverage is there to save time and money by not having to prove fault on relatively minor injuries. Or when for example someone just falls without a reason.

Obviously she is going more than getting her broken nose fixed, or I bet Apple would have already paid (or their insurance company would have already paid assuming they are not self insured).

That would be incorrect. The jury awarded a supersized verdict. The court itself lowered it to $650,000. BOTH parties appealed. But before the appeal they settled confidentially. Tho rumors persist that the settlement was very close to the original verdict. I don't believe anyone knows the exact settlement (other than the parties of course). And yes, it is a poster child for frivolous.
