I bought an iPod 8gb Touch at a pawn shop. After finally successfully deleting previous owners photos and music selections with the help of iTunes, I tried to update to the newer 3. version. I gave them my credit card number for the $4.95 fee but it never downloaded. Calling Apple, I was told I had no warranty and could pay $29.99 for a transfer (?) fee.

Adding these charges to what I paid, I could have come out cheaper by possibly buying a new unit from an authorized dealer.

You should be able jailbreak it and install the update I guess.

It's a small price to pay to make sure you have the hippest brand.

You should have restored as new to the current firmware, set it under tour iTunes account and then upgraded

You first have to wipe it and set it up with your account info. This will restore the latest version of your licensed OS. Then buy the upgrade.

Check for available downloads in iTunes or email support. I've had iTunes support help me out a few times and they are very good
