Some Chicago businesses post "Se Habla Espanol" signs to boast about their Spanish-speaking employees.

But two hair stylists said in a federal lawsuit Thursday that their former bosses at Supercuts posted a different sign:

"Speaking a language other than English is not only disrespectful, it's also prohibited."

Stylists say the notice was put up in 2003, directed at employees as Supercuts managers allegedly barred them from speaking Spanish anywhere at work -- including in the break room or other places outside the earshot of customers.

Supercuts says there is no such ban.

"We absolutely, vehemently deny the allegations and believe the evidence will show otherwise," attorney Davi Hirsch said Thursday.

EEOC on the case

The federal Equal Employment Opportunity Commission, which joined in the lawsuit, argues that such a ban is a violation of the 1964 Civil Rights Act that prohibits employment discrimination based on national origin.

The EEOC, along with private attorney Kamran Memon, brought the lawsuit against Primps LLC and Management Advantage Group LLC, which own more than 20 Supercuts salons in the city and suburbs.

One of the stylists, Rosa Gonzalez, 54, of Chicago, said her bosses shot her dirty looks or would reprimand her if she spoke Spanish to co-workers while on break, or at other times, even when customers weren't around.

The ban was lifted, she said, only if a customer didn't know any English.

"I think it's not fair," said Gonzalez, who came to the United States 27 years ago from Guanajuato, Mexico. "Business[es] need to understand that we are free to speak our language."

No such rule, company says

Memon said Gonzalez and another stylist who filed the lawsuit, Blanca Sauceda, were reprimanded sometimes several times a week for speaking in Spanish on breaks. The two worked for the company at various locations for more than 10 years.

They ultimately quit at their Michigan Avenue location after they felt uncomfortable at work.

Memon said the two wouldn't challenge a policy that limits Spanish being spoken in front of English-speaking customers. But Memon said Gonzalez and Sauceda were told it was "ignorant" and "disrespectful" to speak Spanish at work.

EEOC trial attorney Ann Henry said the suit was brought after managers allegedly enforced a blanket ban at "more than one location."

But Hirsch, who represents the 20 Supercuts owned by Management Advantage Group, said no such ban exists and that the suggestion of one is ludicrous because Supercuts' work force is heavily Hispanic.

Hirsch said there is a written policy limiting language other than English.

"The goal of the policy was to speak essentially whatever language you chose in the lunchroom or on breaks, when you're not servicing customers," Hirsch said.

Hirsch questioned why the employees didn't raise concerns until after they left the company.

I can imagine some short-sighted bigot paranoid might become insulted if their underlings started speaking in a secret language they couldn't understand. That's the only reason a policy like this might exist.

To be fair, it could be more about setting workplace standards. Like requiring workers to wear dress shoes, not tennis shoes at work.

I'd say let the business decide, even if it is an incredibly stupid policy, as this one is.

Yeah, because Supercuts, overall, is a racist business, and should be sued.

Why don't the two employees sue the two managers which are the root of the problem? Oh wait. Because I would imagine the two managers are as poor as they are, and don't have the $$$.

I don't know where this Supercuts is, but there are definitely parts of Michigan Avenue you don't want to be on.

There's a Supercuts on Michigan between Jackson and Van Buren (which, for those who don't know Chicago, is a businessy area near Grant Park, which is our big central park, and which is also near De Paul University). I don't know if that's the one that these women worked at. As nevermind implies, Michigan Avenue extends miles to the south, going through some pretty bad parts of town, and it wouldn't surprise me if there are more SUpercuts along the way.

If "Michigan Avenue" means "Fancy Shops" to you, what you're really thinking of is North Michigan Avenue, which is the northernmost end of the street.

If the management doesn't want workers speaking a language other than English, or cutting hair other than one particular style, or wearing any color other than pink, I don't think there should be grounds for a suit.

people actually get their hair cut at Supercuts? there is one where I live and by looking at the people who work there, i would never get my hair cut there.

Since they suffered no significant harm, and the only issue is that the boss was possibly rude to them, the obvious court decision should be: the boss needs to hand-write them an apology note.

I suspect that since there are a lot of Spanish speaking people in CA that the ban would be a problem in Southern CA.

Okay, that's what I thought as well, but there is a huge 'Hispanic' population (not as large as S.Cal.) in Chicago as well. (and NYC and Texas and Southern FL.)

I heard Alexis Bledel tell a story in an interview of how one time she was getting her hair cut at Supercuts, and the hair stylists started talking amongst themselves in Spanish, the one cutting her hair saying to the next one how bad her hair was coming out, and the other replying "who cares". Alexis speaks Spanish and sat there listening the employees discuss how bad a job they were doing on her hair, and how she looked too dumb to notice anyway :lol:
