Two Durango teens thought they'd surprise neighbors with nighttime deliveries of home-baked treats. But one woman was so terrified, she sued and has won.
Durango - Two teenage girls decided one summer's evening to skip a dance where there might be cursing and drinking to stay home and bake cookies for their neighbors.
Big mistake.
They were sued, successfully, for an unauthorized cookie drop on one porch.
The July 31 deliveries consisted of half a dozen chocolate-chip and sugar cookies accompanied by big hearts cut out of red or pink construction paper with the message: "Have a great night."
The notes were signed, "Love, The T and L Club," code for Taylor Ostergaard, then 17, and Lindsey Jo Zellitti, 18.
Inside one of the nine scattered rural homes south of Durango that got cookies that night, a 49-year-old woman became so terrified by the knocks on her door around 10:30 p.m. that she called the sheriff's department. Deputies determined that no crime had been committed.
But Wanita Renea Young ended up in the hospital emergency room the next day after suffering a severe anxiety attack she thought might be a heart attack.
A Durango judge Thursday awarded Young almost $900 to recoup her medical bills. She received nothing for pain and suffering.
"The victory wasn't sweet," Young said Thursday afternoon. "I'm not gloating about it. I just hope the girls learned a lesson."
Taylor's mother, Jill Ostergaard, said her daughter "cried and cried" after Judge Doug Walker handed down his decision in La Plata County Small Claims Court.
"She felt she was being punished for doing something nice," Jill Ostergaard said.
The judge said that he didn't think the girls acted maliciously but that it was pretty late at night for them to be out. He didn't award any punitive damages.
Taylor and Lindsey declined to comment Thursday, saying only that they didn't want to say anything hurtful.
Young said the girls showed "very poor judgment."
But Taylor had asked her father's permission to bake cookies for the neighbors after livestock-tending chores were done.
"I said, 'Go ahead, as long as I get some cookies,"' Richard Ostergaard said Thursday.
Just as dusk arrived a little after 9 p.m., Taylor and Lindsey began their mad spree. They didn't stop at houses that were dark. But where lights shone, the girls figured people were awake and in need of cookies. A kitchen light was on at Young's home.
Court records contain half a dozen letters from neighbors who said that they enjoyed the unexpected treats.
The cookies were good. It was a nice surprise. They weren't scared.
But Young, home with her own 18-year-old daughter and her elderly mother, said she saw shadowy figures who banged and banged at her door. When she called out, "Who's there?" no one answered. The figures ran off.
She thought perhaps they were burglars or some neighbors she had tangled with in the past, she said.
"We just wanted to surprise them," Taylor said.
Young left her home that night to stay at her sister's, but her symptoms, including shaking and an upset stomach, wouldn't subside. The next morning she went to Mercy Medical Center.
"We feel that knocking on a door and leaving cookies is a gesture of kindness and would not create an anxiety attack in the general public," Taylor's parents wrote to the court.
The girls wrote letters of apology to Young. Taylor's letter, written a few days after the episode, said in part: "I didn't realize this would cause trouble for you. ... I just wanted you to know that someone cared about you and your family."
The families had offered to pay Young's medical bills if she would agree to indemnify the families against future claims.
Young wouldn't sign the agreement. She said the families' apologies rang false and weren't delivered in person. The matter went to court.
Young said she believes that the girls should not have been running from door to door late at night.
"Something bad could have happened to them," she said.

While I would never dream of violating forum rules for posting someone's address without permission, it took about about 30 seconds with a quick google search using "Durango" "colorado" "yellow" and "pages" to find the crazy bitch's address and phone number.

There's two in that area. One is to the west, in the town proper. You dont want that one. The one I found, on the other hand, was about 10 miles (give or take) south of Durango, at the end of a dead end road - so I'd lay money that is the right one.

More and more each day, it becomes clear that associating with other people is vastly overrated. Too many overly litigious, downright loony people out there, and a completely batty legal system all too eager to pander to them. It's really at the point where you have to think twice about helping someone who is sick or needs CPR or something because these days they;d sue you at the drop of a hat for some ridiculous reason.

The funny thing is that the knock and run killing took place in Boca Raton, in a nice neighborhood. Just another example of one of these paranoid people that have no grip on reality. The guy was charged though, not sure exactly what he got though.

I live in a small town (1000 people) and have all my life and yes it would freak me out. Not to the extent that I would sue them mind you. :lol: It was a nice gesture but is it hard to let people know who they are from? Like personally giving them to people instead of all the sneaky sneaky freaky love note shit? Yes it is sad but with all the sick freaks in the world you have to be careful. Small towns aren't so innocent as you may think. Mine town has meth busts more than a couple of times a year.

The woman that sued was on Dayside today on FOX News. She said she knew one of the girls and that they lived 10 miles away. The girls parked their car and walked across a field, through a ditch, over a fence and left the cookies on their back door step were there was no light and then banged on the door. That was her side of the story with is absent from the article. There was more but I don't remember the rest. Like I said it was a nice gesture but maybe they should have knocked on the front door and told the psycho about the cookies.
And no not all teens are bad or out to do bad things. Most of the teens I know in my town are good people and so are the people I grew up with. It's outsiders that come move in and cause all the trouble but that is for another thread.

Young wouldn't sign the agreement. She said the families' apologies rang false and weren't delivered in person.

The thing that chaps my ass is Young found out it wasn't some crazed killer or rapist, and still after being given a written apology and an offer to pay the medical bill (with full knowledge of who gave her the cookies and their intention) she decides that it would be best to sue the girls in order to "teach them a lesson". There was absolutely no cause for that. It said in the article that she was advised to not sign the agreement, although it doesn't say by who (coughhusbandcough) yet there isn't any note that she regrets going too far. I also think the girls should have taken into consideration we live in 2005. At Halloween I made Rice Crispie Treats as treats to go along with the candy. I attached labels with my name, address, phone # and Happy Halloween Neighbor! on them. I didn't want parents to freak out thinking they had been spiked. The girls shouldn't have been delivering them like that at 10:30 at night, and they should have been personally delivered imho, not run off.
BUT the woman had absolutely NO reason to sue. She was just a bitch!

I want the express to you a heart felt thanks and sincere appreciation that you, and so much of America and Canada, have shown them. This alone more than makes up for the stress and worry they have experienced the past six months as well as the big disappointment of the trail ruling.
