Spike TV Might Not Come To Pass! Spike Lee Wins Injunction!

Spike Lee won a preliminary injunction this afternoon that could keep Viacom from naming its network Spike TV, as is scheduled for Monday.

Manhattan State Supreme Court Justice Walter Tolub granted Lee's injunction, but ordered him to post a $500,000 bond. The judge said that if Lee doesn't win a permanent injunction barring the name change, he would have to pay Viacom's legal expenses and other costs.

"In addition to the name Spike, there are other indicia that defendants sought to exploit Mr. Lee's persona, most notably Mr. Lee's reputation for irreverence and aggressiveness," Tolub wrote in his ruling. A hearing on the case is scheduled for 6/23.

Tolub also wrote, "At first blush (Lee's lawsuit), to be an exercise in egocentricity, it's actually an earnest attempt by a prominent personality to limit what he regards as the commercial exploitation of his public persona."



This is ****ing ridiculous.

wow, so what is Spike TV going to do? They launch this weekend, right? Do they postpone the launch?

Oh my god.

Had the network been saying, "Coming soon, SpikeTV, the first network for people who hate white people and Reggie Miller!" he may have had an argument. But when did Lee win the patent on "agressiveness?" This is the worst thing to happen since...since...well, since TNN came up with that stupid ass name.

Sad world were this loser can get a station not to name itself spike just because he is named that. If TNN tried to name itself "Spike lee's tv hood" then maybe.. just maybe but as it is.. it's sad

Hell, after a 6 pack of Coors light it still sounds like "Nashville"

the moment someone does something this stupid, they lose a lot of credit in my mind. His movies were very off and on. some where well placed and thought out. Others just seemed like he wanted to get attention for the hell of it. One of the best directors? nah, I wouldn't call him that.

When you sue a station because it has the same name as your first name, which in this case is a common name for many different things, it becomes very annoyng and I call him a loser because even though it looks like he is winning this lawsuit, he ends up a loser in the end within the publics eyes.

Granting this preliminary injunction appears stupid beyond belief. But I don't see how Lee can win and get a permanent injunction. And if he loses, he will have to pay Viacom's legal expenses and other costs out of the $500,000 bond he must post to pursue this further. If he has any sense he will not post the bond and give this silly thing up (the article doesn't say he has agreed to post the bond). If he does post or has posted the bond, he is going to lose and be out some serious bucks. I'm sure he's pretty well off financially but I'm equally sure he's no Steven Spielberg in that department. A half million dollars has got to be something he'd feel.

So does anyone know if he has posted or will post the bond?

I think this lawsuit is stupid, but to call one of America's best directors a loser is pretty lame.
I think calling this arrogant, loud-mouthed, racist one of America's best directors is ridiculous.
