Creed sued for a bad concert

http://www.thesmokinggun.com/archive/creedsuit1.html

Normally I would say that this was a frivolous lawsuit, but tickets were $50 each (plus $5.50 Ticketmaster charge), and the lead singer was so drunk or high that he couldn't perform a single song, left the stage for long periods of time, writhed on stage in apparent pain, and apparently passed out for awhile.

Creed should immediately have promised to have a free makeup concert, instead they appologized for the crappy concert and promised to have their best ever concert the next time they came back. Riiiight, if I got stuck for $50 / ticket, I wouldn't see them again.

I wish the plaintiffs luck in this one.

I agree with their claim that this is tantamount to a cancellation. If they have proof of all this foreknowledge that they mention, they may have a case.

What happened in the Pearl Jam case?

And mods, please don't lock this thread. I now know that there is a thread from months ago about the Creed concert, but this thread is about sueing bands that have really bad performances, not about Creed in particular.

PS: if Groucho's (Pearl Jam) comment was a serious one it would be a rare thing!

Nah... Eddie Vedder knows how to handle his liquor. It's pretty simple, actually. You just take the bottle, drink it down... Pass it around.

I think this is actually a good lawsuit. If I go to a concert and the singer is so drunk or hyped up on drugs (prescription or not) or a little of both that the band can't even put on a good show, then I expect a refund. If they can't give refunds then they should have a second show or offer tickets to a future show.

Beyond the expenses of buying tickets and paying for parking. Going to a concert has all sorts of other incidental costs. Typically you choose to eat out, sometimes you have to leave work early, you've got lost opportunity costs in that you could be doing other things during the concert.

I think it's high time performers do what they are getting paid to do...perform.
